International Consultant: Expert in Comparative Police Legislation

The Police Reform Programme (PRP) is a long-term and comprehensive capacity building initiative to improve human security in Bangladesh. PRP supports the transition from a colonial style police force to democratic policing by strengthening the Bangladesh Police’s ability to contribute to a safer and more secure environment based on respect for the rule of law, human rights and equitable access to justice. The Ministry of Home Affairs and Bangladesh Police drive the reform process with technical and financial support from UNDP and other development partners. A vital aspect of the reform programme is the reform of police related legislation to assist the police to better respond to the needs of the general public.

OBJECTIVES OF THE ASSIGNMENT

The police reform process in Bangladesh continues to make progress in a number of areas but there is a belief that further gains will not be sustainable without amendment of the colonial era Police Act (1861). This law like many British colonial police laws was based on the legislation governing the nineteenth century Royal Irish Constabulary. In 2007 a draft Police Ordinance was prepared to replace the 1861 Act but its progress has become stalled due to a lack of consensus within Bangladesh regarding the utility of aspects of the draft law. Media and civil society also continue to advocate for a new Police Law but many stakeholders legitimately worry about issues related to command and control, superintendence and oversight and accountability.

In order to help encourage fresh debate on police legislation the PRP is seeking a consultant to identify international experience of police legislative reform. This support will comprise of two separate but linked parts. In Part One the consultant will produce two pieces of research outlined below. Then In Part Two, should it be deemed necessary, the consultant will be asked to come to Bangladesh to present the research to key national stakeholders in a number of seminars and workshops.

Part One

The first report will be an evaluation of the experience of redrafting police laws from a number of different jurisdictions. It is essential that this review will assess the 1861 Police Act prior to examining the experience of other jurisdictions that have also inherited the 1861 Act (India and Pakistan) as well as at least three other countries which have attempted to reform police legislation initially based on the Irish Constabulary model. Countries/jurisdictions that should be included are Northern Ireland, South Africa and one of the following Namibia, Kenya, Maldives or Malaysia. The final list of countries and methodology will be agreed between the consultant and the PRP and outlined in the inception report. It is expected that sections of the report will cover among other issues models of police superintendence, external police oversight mechanisms, community engagement, role of the interior (Home) ministry and the practical experience of applying legislation. It may be necessary for the inception report to be delivered in person in Dhaka or alternatively via a skype conference call.

The consultant will then be required to complete a second report comparing the draft text of the 2007 Draft Police Ordinance with international better practice as identified in the first report. The aim of this second report will be to ensure that debate about the development of the 2007 Draft Police Ordinance is informed by international experience and better practice.

Part Two

In order to take part in this debate it may be necessary to make a number of workshop presentations to groups of key stakeholders. The key role of these workshops would be to discuss police legislation reform with key stakeholders (police, civil service, NGOs and the media etc) to try and help develop a consensus on police legislative reform. The desirability of this part of the contract will be discussed and agreed with the consultant towards the end of Part One.

Duties and Responsibilities

Part One

  1. Producing report (including executive summary and comparative matrix) on comparative police legislation in at least five different jurisdictions (50-100 pages): 25 days
  2. Producing an analysis (including a comparative matrix) of the 2007 draft police ordinance against international better practice as identified in comparative police legislation report (10-20 pages): 7 days
  3. Preparing two PowerPoint summaries of both reports: 1 day
  4. Producing two summary reports for presentation at workshops (5-10 pages) : 2 days

Total Number of working days in Part One: 35 days

Part Two

  1. Presenting research at between four and eight round table consultations and possibly one conference: 8 days
  2. Producing workshop reports (2-3 pages): 4 days

International Consultant: Expert in Comparative Police Legislation

International Consultant_Governance Performance Monitoring Expert

The current Government of Bangladesh has identified the establishment of good governance as one of its main priorities. The creation of a modern, effective, transparent, accountable and responsive civil service has been identified as key to achieving that aim. The Civil Service Change Management programme (CSCMP), a joint programme of the Government of Bangladesh and UNDP, is providing assistance to gradually transform the civil service. With an emphasis on endogenous institutional development, its use of modern change management techniques, and its focus on selected strategic interventions with potentially high leverage impact, CSCMP has worked in partnership with the civil service to provide the necessary tools to support change, innovation and reform that is required.

CSCMP has provided strategic and technical assistance to formulate and develop a comprehensive vision and set of priorities for reform of its structures, business processes and approach to public service delivery. This includes reform of the legal framework, human resource policies including greater gender sensitive approaches, structural enhancements, civic engagement and increasing ICT capacity. By strengthening the organisational performance of the civil service, the quality, standard and delivery of basic public services will improve and the ultimate target groups of the project, the poor, women and children, will benefit by increased access to these services and benefits.

As part of its support to the implementation of the reform priorities, CSCMP has been requested to assist in the setting up of a Change Management Unit in the Prime Minister’s Office. The Unit will consist of a high-level committee of senior representatives of the government and civil service and a small scale technical assistance staff. The purpose of the assistance would be to boost capacity for research, planning, monitoring and evaluation to support the design and implementation of robust policies by the Unit, concentrating on three areas: good governance (including civil service reform), private/public sector interface and communications. CSCMP, therefore, is looking for a team of three (3) experts with complementary knowledge and experience to collectively and individually provide technical assistance on good governance planning, communication, implementation and monitoring to the Unit, including a governance performance monitoring expert.

Duties and Responsibilities

Provide technical support to Change Management Unit at the Prime Minister’s Office in Governance Performance Monitoring:

  • Research good governance issues and priorities in Bangladesh
  • Develop governance performance monitoring systems, including the development of a good governance performance dashboard
  • Assist in developing key performance indicators and their adaptation to the country context
  • Provide expertise on internal monitoring and evaluation approaches of business processes related to civil service institutions
  • Developing business plans, models and change ideas and their adaptation for the country context and for civil service change management
  • Assist in developing public accountability and measurement tools for the civil service
  • Collect, in a systematic way, objective data on governance performance
  • Write reports, papers and recommendations on governance performance
  • Ensure the inclusion of such data and systems in the design and formulation of good governance policies
  • Engage and liaise with a range of stakeholders from civil society, academic networks and external specialists involved in good governance issues, for advisory services and sharing of information/best practices
  • Supply the Change Management Unit with relevant updates on a regular basis
  • Organise high level discussions, dialogues and roundtables on relevant topics
  • Liaise between CSCMP/UNDP and the Unit.

Impact of Results:

The key results have an impact on the improvement of good governance in Bangladesh, in particular the civil service, thereby contributing to the further development of the civil service into a modern, responsive and accountable public service provider.

  • High level of proficiency in written and oral English, working knowledge of Bangla is a recommendation;

Bangladesh - Head of Mission - Dhaka

MISSION

Solidarités International is a French humanitarian organization which provides aid and assistance to victims of war or natural disaster. For over 30 years the association has focused on meeting three vital needs - water, food and shelter - by carrying out emergency programmes followed by longer-term reconstruction projects. Whilst fully respecting the assisted populations’ customs and culture, Solidarités International’s programmes are implemented through the joint expertise of around 150 expatriates and 1500 local managerial staff and employees. Solidarités International is currently present in Africa (Burundi, Central African Republic, Southern Sudan, Kenya, Somalia, Liberia, Chad, Democratic Republic of the Congo, Republic of Côte d’Ivoire, Zimbabwe), in Asia (Afghanistan, Thailand, Bangladesh, Myanmar) and in Haiti.

CONTEXT OF INTERVENTION

Despite a stable political situation, Bangladesh is still struggling to reach the Millennium Development Goals and to become a middle-income country. There is no constant humanitarian crisis within the country; however, frequent natural disasters prevent the development of Bangladesh and increase the vulnerability of its population in both urban and rural areas.

Bangladesh is the most densely populated country in the world, and has indeed been rated as the country the most vulnerable to natural disaster by the Natural Disaster Risk Index taking into account the human and material impact of natural disasters and their frequency.

With 82% of the population living on less than 2 USD per day and a Human Development Index (HDI) that ranks Bangladesh 146 out of 182 countries listed, the humanitarian situation is still extremely worrying. In the field of water and sanitation 20% of the population live without improved access to water and 64% without access to improved sanitation facilities.

In the field of food security, 46% of the under-five are suffering from underweight and the Global Hunger Index for 2010 was 24.2 (rates above 20 are considered as alarming situation).

Solidarités International has now been present in Bangladesh for 3 years. Our overall operational objective for 2011 is to improve the living conditions and resilience capacity of those most vulnerable to natural disaster and discrimination (migrants, refugees, and the urban and rural poor).

In Bangladesh, Solidarités International targets the primary needs of crisis-affected persons in terms of food security; water, hygiene and sanitation; and shelter. SI is currently implementing projects in two different areas of intervention: early recovery programs in the wake of the AILA cyclone in the coastal belt, with a broad scope of activities in shelter, water access, hygiene and sanitation; and water, hygiene and sanitation projects in Cox Bazaar district for both Rohingyas refugees and host communities.

In addition SI has a preparedness plan in place which enables us to mobilize resources on extremely short notice and to quickly and adequately respond to emergencies in case of a disaster.

OUTLINE OF POST

The Head of Mission is the Solidarités International official representative in Bangladesh. In terms of personnel, the mission includes 7 expatriates and 100 national staff members.

- S/He is in charge of the smooth running of the mission.
- S/He proposes mission strategy, according to the geopolitical and humanitarian context and ensures its implementation.
- S/He monitors projects, ensuring that they are progressing in accordance with Solidarités International charter and Code of Ethic and Conduct and complying with internal and contractual procedures.
- S/He mobilizes the material and financial resources necessary for the programs to run effectively and supervises the administration of these resources.
- S/He coordinates the teams in place and ensures their security on the mission.
- S/He is the direct liaison for Solidarités International HQ.

RESPONSIBILITIES

Coordination and strategic orientation:
- Monitor and analyze the humanitarian, political, cultural, social and economic context with the support of the Assistant Head of Mission
- Propose and develop an operational strategy consistent with the association’s policies and population’s needs
- Ensure the programs are implemented and developed in accordance with annual operational strategy
- Propose new operational directions as contexts change in collaboration with the Program Coordinator and the Field Coordinator

Relevance and operational quality / operations monitoring:
These tasks fall under the responsibility of the Program Coordinator but the HoM will have the overall responsibility in terms of supervision:
- Supervise the coordination, development, monitoring and evaluation of programs
- Ensure the relevance, quality and consistency of programs
- Ensure that programs are implemented in accordance with Solidarités International’s technical requirements

Resource management:
These tasks fall under the responsibility of the Log/ Admin Coordinator but the HoM will have the overall responsibility in terms of supervision:
- Propose and organize the human, financial and logistical layout of the mission
- Ensure the financial resources and means necessary for the completion of projects are mobilized
- Guarantee that resources are used effectively
- Ensure that programs are implemented in accordance with financial donors’ criteria

Human Resources management:
- Build and maintain team dynamics that enable Solidarités International’s objectives to be carried out effectively in the country
- Promote Solidarités International’s ethics and values
- Make sure the Log Admin Coordinator guarantees the respect of Solidarités International’s Human Resources policies
- Ensure work-life balance for Solidarités International staff and maintain suitable working and living environments
- Manage the coordination team as well as staff s/he supervises directly

Security:
- Be responsible for the security of all teams and property on the mission
- Monitor and analyze the security situation
- Ensure that every new arrival on the mission receives a geopolitical and security briefing
- Ensure that everyone complies with security rules and procedures on the mission
- Deal immediately with any security incidents that may occur

Relationships with financial donors / fund-raising:
- Monitor and analyze financial donors’ strategies
- Lead the fund-raising at mission level and ensure the mission’s financial stability
- Strengthen relationships between Solidarités International and financial donors’ representatives

Internal and external communication:
- Ensure that deadlines are adhered to and that documents produced by the mission are of good quality
- Ensure compliance with formats and procedures in internal reporting
- Organize coordination meetings on a regular basis
- Ensure that key operational information circulates on the mission and between the mission and HQ
- Make sure that the communications department at HQ level receives sufficient and up-to-date material

Representation:
- Act as Solidarités International’s official representative in the country for aid workers, local political and administrative authorities, the civil society and the media
- Attend humanitarian forums and relevant coordination meetings

NGO AB:
- In collaboration with the Log Admin Coordinator, make sure that SI follows NGO AB rules
- Follow-up with the Assistant HoM the overall documents submitted to the NGO AB

CANDIDATE PROFILE

Education:
- Postgraduate-level qualification in development studies (desirable but can be balanced by experience)

Experience:
- Substantial experience in a senior management position in an overseas NGO environment, ideally in both emergency and developmental contexts
- Experience of strategic planning
- Experience of managing large teams in multiple locations with various problematics
- Experience of budget management and donor compliance
- Experience of establishing strong working relationships with colleagues from different cultures and in different positions

Technical skills and competencies:
- Excellent representational skills; able to represent SI to a broad range of people and organisations including donors and government officials
- An ability to reflect on and learn from own performance and the performance of the program; and to put these lessons into practice
- A good understanding of security management, DRR and climate change issues
- Confident and proficient in the use of MS Office

Personal qualities:
- An ability to analyse information quickly and accurately
- Good problem-solving skills in day-to-day and crisis situations

CONDITIONS

Salaried post: from 2100 euros gross per month, according to experience.

Solidarités International will cover accommodation and travel expenses from the expatriate’s home country to the site of the assignment. A monthly Per Diem of 450 USD will be provided to cover food and other living expenses.

- Social and medical cover: Expatriates benefit from an insurance package which reimburses all healthcare expenses (including medical and surgical expenses, dental care and ophthalmological expenses, repatriation) and a welfare system including war risks. Essential vaccination and antimalarial treatment costs are refunded.

- Vacation: During the assignment, a system of alternation between work and time off is implemented at the rate of one break every three months. For a one-year assignment, the expatriate will have a break during the 3rd and the 9th month (with 500 euros allocated by Solidarités). He or she will also be entitled to go back to his or her home country for a 15-day period after six months spent on the mission (Solidarités will cover travel costs).
