Employment Opportunities in Uganda

The Justice Law and Order Sector (JLOS) is a sector wide approach adopted by Government of Uganda in 1999 to improve the administration of justice, maintenance of law and order and strengthen the rule of law in Uganda.

JLOS thus brings together all institutions charged with the administration of justice, maintenance of law and order and human rights.

JLOS programmes are supported through the sector wide approach to planning, budgeting, programme implementation, monitoring and evaluation with a shift of focus from institutional interests to sector wide strategic interests through a rationalized application of resources from the Government of Uganda and Development Partners.

JLOS is a reform programme run under a common investment plan, whose short term strategic objectives include adherence to the rule of law, fostering a culture of human rights, access to justice, reducing the incidence of crime and contributing to economic development.

In the long term, JLOS strategic objectives will be narrowed to three strategic objectives of strengthening policy and regulatory frameworks, access to justice and fostering a human rights culture and accountability to bring them in line with the National Development Plan.

JLOS is overseen by the Leadership Committee, Steering Committee and Technical Committee with a secretariat made of different advisors who support the four thematic areas of criminal, land, commercial and family justice.

JLOS therefore, wishes to recruit two advisors (consultants) to wit the Technical Advisor for Family and Criminal Justice and Financial Management Specialist on the terms indicated below:

1 TECHNICAL ADVISOR- FAMILY AND
CRIMINAL JUSTICE
Description of the Services

The Technical Advisor, Criminal and Family Justice will provide technical leadership and guidance necessary for successful implementation of the Criminal and Family Reform Programme as follows:

1. Develop researched strategies for effective implementation of the Criminal and Family Reform Programme.
2. Coordinate the development of action plans and budgets for the Criminal and Family Reform Sub- Programmes.
3. Provide technical advice for the implementation of Criminal and Family Reform Sub-Programmes.
4. Contribute to the development of the monitoring and evaluation system particularly for the Criminal and Family Reform Programmes.
5. Monitor and evaluate the implementation of the Criminal and Family Reform Programmes.
6. Prepare quarterly, semi-annual and annual monitoring and evaluation reports on Criminal and Family Reform Programmes.
7. Identify and forward constraints to achievement of the Criminal and Family Reforms to the relevant Committees and Working Groups for redress.
8. Prepare analysed and comprehensive progress reports on Criminal and Family Justice Programmes within the overall reform program for the Semi annual and Annual reviews.
9. To provide secretarial services to the Criminal and Family Justice Working Group and other sector meetings.
10. Perform any other duty that may be assigned from time to time.

Qualifications
The successful candidate should have:
A master’s degree in law from a recognized university.
A thorough understanding of contemporary legal and justice reforms in developing countries such as Uganda.
A thorough understanding of family and criminal justice issues.
At least five years’ experience in programme implementation, legal or access to justice reforms.
Experience working with Donor agencies.
Excellent knowledge of the public sector and
sector-wide approaches to reform.
Understanding of the public sector planning in Uganda

The successful candidate should have the following skills:
Proficiency in the use of standard computer software, including Microsoft Word, Excel and PowerPoint;
Excellent presentation skills;
Highly developed inter-personal and analytical skills;
A high level of self-motivation and flexibility;
Team player; and
Excellent writing, research and reporting skills

Terms and Conditions:
The succeeful applicant will be offered a one year contract on competive terms tenable at the JLOS Secretariat.

2 FINANCIAL MANAGEMENT SPECIALIST
Description of the Services:

1. The role of the Financial Management Specialist
(FMS) will be to:
i) Coordinate and control activities in the financial management strategy, bearing in mind existing initiatives e.g. the Integrated Financial Management systems of Ministry of Finance, Planning & Economic Development;
ii) Schedule implementation in an orderly, logical and timely fashion;
iii) Submit periodic reports to the Technical and Steering committee, providing status and highlighting problem areas of the implementation;
iv) Prepare terms of reference for the out-sourced work;
v) Drive issues to resolution;
vi) Ensure successful implementation of the financial management strategy.

Key Responsibilities:
2. Key responsibilities of the FMS include:
i) In the short term – oversee the implementation of key procedures to strengthen accountability measures, particularly in regard to non-tax revenue and use of imprest;

ii) Development of training and incentives programme based on needs identified in financial management to enhance capacity and enable retention of skilled staff into the sector;

iii) Develop systems for budget planning process and facilitate preparation of and develop the annual Budget Framework Paper working closely with the sector budget working group, with particular regard to fiscal policy analysis and linkages to the sector objectives, inputs, output and outcomes;

iv) Develop mechanisms for monitoring and tracking utilization of sectoral funds;

v) Analyze and submit financial reports on sectoral programmes including analysis of budgets and budgetary trends for the sector and advice on the overall financial aspects of the sector;

vi) In the long term, provide strategic guidance and oversee implementation of the broad sector financial management strategy, on an annual basis.

vii) Prepare sectoral budget framework paper and other financial report as demanded by Government of Uganda and Development Partners.

Qualifications and Experience:
The qualified candidate should have the following qualifications:
A Financial Management qualification and membership of CPA, ACCA, CIMA, or equivalent.
A Masters in Accounting and Finance will be added advantage.

Must possess proven experience of Project Planning & Management Skills in Public Sector or with an International Organisation for a period of not less that 5 years

Good interpersonal skills, excellent communication (written and spoken) and presentation skills.

A high level of self-motivation, flexibility and ability to work under very tight deadlines.

Ability in a cross cultural and disciplinary environment and be a team player.

Sufficient professional experience and mature enough to provide strategic direction and gain the cooperation of both policy and technical leval staff in the sector Competence in the use of standard computer software, including Microsoft word, excel, access and power point.

Additional Skills:

Functions: A Judge of the Supreme Court shall serve in the Supreme Court of Kenya and shall exercise the following functions:

  • To hear and determine in its appellate Jurisdiction appeals from
  1. Court of Appeal and

Constitutional and statutory requirements for Appointment

For appointment to the position of Judge of the Supreme Court, the applicants must possess the following qualification:

(b) At least fifteen (15) years experience as a distinguished academic, judicial officer, legal
practitioner or such experience in other relevant legal field; or

(c) Held the qualification specified in paragraphs (a) and (b) for a period amounting, in aggregate, to fifteen years (experience gained in Kenya or in another Commonwealth common law jurisdiction will be considered).

(d) Have a high moral character, integrity and impartiality. This appointment and any subsequent extension(s) are subject to terms of the Tribunal’s mandate and/or the availability of the funds. The Special Tribunal for Lebanon is an international inter-governmental organization with its own independent legal identity and not a UN organization. However, STL follows the UN common system for benefits and entitlements to its staff members. UN staff members may also serve on loan from their parent department/office, if selected.

RESPONSIBILITIES:

Under overall authority of the Registrar and direct supervision of the Chief of Administration, the incumbent directs the personnel management activities of the Special Tribunal for Lebanon while supervising, reviewing and coordinating the work of the Human Resources Section. Provides guidance to section staff on the correct applications and observance of Tribunal Staff Regulations and Rules, and cases relating to personnel policies and appeals, in both The Netherlands and the Beirut Office. Exercises delegated authority to approve exceptions to rules and regulations on personnel entitlements or variations to the Tribunal’s polices. Develops and implements new policies, practices and procedures to meet the evolving needs of the Tribunal; identifies developments in personnel management polices/practices and makes recommendations as appropriate in maintaining alignment with the UN common system. Drafts administrative issuances and circulars relating to personnel matters. Provides authoritative advice to senior management on personnel matters, including advising on new approaches and adaptations of existing policies. Advises the Chief of Administration on issues relating to staff management relations. Leads and provides guidance with regards to personnel section staff responsible for administration of entitlements and benefits and recruitment. Ensures that common system standards of entitlements and benefits are adhered to and the Tribunal's recruitment policies and procedures are followed. Administers and advises on social security schemes including health and services incurred death and disability insurance. Serves as Certifying officer of budget accounts concerning staff costs and personnel entitlements. Monitors the implementation of training and career support programmes. Provides performance management advice to staff and management. Advises and counsels staff in respect of rights, responsibilities, code of conduct and difficulties associated with work and entitlements. Monitors, advises and acts on disciplinary matters in accordance with established policies and procedures. Mediates conflict, grievance and harassment cases. Monitors staff health & welfare and identifies/proposes appropriate programmes and remedial action. When required, represents the Tribunal in inter-agency meetings on employment policies, local practices, local markets, and other related personnel matters, including information on personnel policies and procedures. Drafts, reviews, approves or recommends for approval, documents and position papers on substantive human resources issues. QUALIFICATIONS:

Education: Advanced university degree (Master’s degree or equivalent) in human resources management, business or public administration, social sciences, education or related area. Documented equivalent combination of relevant experience and formal education/training may be considered appropriately.

Experience: Minimum of 7 years (9 if in possession of a Bachelor level degree) of progressively responsible and relevant experience in human resources management, administrative services or related area. Appropriate degree of experience in supervisory capacities.

Languages: Arabic, English and French are the official languages of the Special Tribunal for Lebanon. For this post, fluency in written and oral English with strong drafting skills in English are required. Knowledge of the other official languages is an asset.

icipe Legal Officer

icipe is an intergovernmental organisation funded by government aid agencies, UN organisations and private foundations to carry out research and training in environmentally sound and sustainable management of arthropods for improving health and agricultural productivity in the tropics.

icipe has approximately 300 staff to support its research and capacity building programmes, located at various sites in Kenya, Ethiopia and Sudan.

icipe wishes to urgently recruit a suitable candidate to fill the position of Legal Officer to be based at its Headquarters at Duduville campus, Kasarani, Nairobi Kenya. The position is offered on two year contract terms that are renewable.

Objectives

The main objectives of this position include the following:
  • To provide support to management and staff of icipe in the review, negotiation and drafting of research, collaborative and material transfer agreements.
  • To provide advice to management and other professional staff of icipe on the icipe Charter and the Headquarters’ Agreement with the Government of Kenya.
  • To oversee the process of regularizing / harmonizing Title documents of icipe’s immovable assets.
  • To advise management on the management of the Centre’s Intellectual Property and related rights.
  • To advise management on appropriate IP strategies to employ in the protection and dissemination of the Centre’s research results in line with its research mission, and this may include but will not be limited to the registration of patents, trademarks and utility models.
Requirements
  • Be a holder of a bachelor’s degree in law from a recognized university
  • Be an Advocate of the High Court of Kenya and with admission to practice before the Kenya Industrial Property Institute (KIPI)
  • Be a Commissioner for Oaths and Notary Public
  • Be a Certified Public Secretary (CPS)
  • Have at least five years’ working experience in an international organization
  • Applicants with another degree in science or a Master’ degree in Business Administration but who have previously carried out registration of patents and other IP related rights will also be considered.
  • Be proactive and self motivated and able to work with minimum supervision
  • Excellent communication, research, presentation and analytical skills
  • Proficient in computer skills (MS- Office suite etc)
Responsibilities

Reporting to the Director of Finance and Administration, the Legal Officer will perform the following duties among other things:
  • Draft collaborative research agreements, memoranda of understanding, research contracts etc for collaboration / cooperation between icipe and other parties / partners
  • Review research agreements, memoranda of understanding, research contracts for proposed collaboration between icipe and other parties.
  • Advise management and staff on new developments on legal matters at national, regional and international level.
  • Oversee the maintenance and custodianship of icipe’s immovable assets.
  • Oversee maintenance of icipe’s Intellectual Property Rights including coordination of their protection and prosecution.
  • Liaise with external counsel
  • Carry out other responsibilities as may be assigned from time to time.

Human Rights Program Officer

INTERNATIONAL SENIOR LAWYERS PROJECT seeking Human Rights Program Officer

The International Senior Lawyers Project seeks a dynamic, motivated and thoughtful lawyer for the position of Human Rights Program Officer.

Overview of Organization:
The International Senior Lawyers Project (ISLP) provides pro bono legal services by experienced attorneys and distinguished law firms to advance democracy and the rule of law, protect human rights and promote equitable economic development worldwide. ISLP helps governments and civil society develop and implement legal reforms, assists programs that advance the social and economic well-being of people in developing countries and builds the capacity of local organizations and professionals to meet the needs of their communities.
ISLP has a paid staff of nine, eight in New York and one in Paris. To supplement and enrich this staff capacity, six senior volunteer lawyers coordinate or advise on significant programs. In 2010, ISLP sent nearly 80 lawyers overseas in 2010 on 113 project-related trips, with participation of volunteers from the United States, Belgium, Canada, Colombia, France, Holland, Portugal and the United Kingdom, as well as many others working from offices all over the world. Our human rights, economic development and rule of law projects took place in, or affected, 30 countries in 2010 and more than 50 in our 10-year history.
ISLP currently provides assistance in four primary ways: (1) we send highly experienced lawyers abroad to work onsite to strengthen the capacity of local NGOs and government agencies; (2) we provide high level transactional legal counsel in areas ranging from contract negotiations to advice on intellectual property laws; (3) we conduct training on best practices, legislative drafting, negotiation and litigation skills and other subjects; and (4) we provide research and writing on human rights issues for briefs, manuals and other materials.
Responsibilities of Human Rights Program Officer:
The Human Rights Program Officer will work with the Executive Director and the Associate Executive Director to expand and strengthen ISLP’s work with human rights organizations and government agencies around the world. He or she will also help ISLP implement the goals of a Five-Year Plan adopted by the Board of Directors in October 2010. In addition to continuing the successful approach ISLP has followed to date, the Plan calls for developing new country-focused programs, strengthening and adding to areas of thematic focus and developing stronger tools and procedures to evaluate the achievements and assess the impact of ISLP's activities.

The Human Rights Program Officer will contribute in other ways as well, including, in particular, working with staff to help produce written materials about the human rights program and working with the Volunteer Coordinator to identify appropriate volunteers for human rights work and develop training materials and other support systems for volunteers. Because we have a small staff, each staff member is required to multitask and assist in sometimes unpredictable ways.
Some travel will be required to develop new programs, evaluate potential partners, and assess the impact of previous projects.


Qualifications:
The position requires a J.D. degree, fluency in English and at least five years of experience practicing law or developing programs in international legal reform and/or human rights. The ideal candidate will be deeply committed to the mission of ISLP, a quick learner, self-motivated and imaginative, able to write clearly and persuasively about ISLP’s projects and achievements, have excellent organizational and communication skills, have a congenial and diplomatic personality and be able to work effectively with a wide range of constituencies. Other preferred qualifications include fluency in a nonEnglish language and experience with public interest or private law practice.


Salary: $65,000.

PhD candidate in law - Conflict of Interest in the Public Sector

The PhD candidate will develop a doctoral dissertation (in English) on types and instruments of regulation to control conflict of interest in the public sector and mechanisms to implement and enforce regulation in developed and developing countries. PhD position

Professor Anne Peters, Vice-President of the Board of the Institute, will be the academic supervisor.

The candidate will be provided a work station at the Institute. The supervisor will be assisting the candidate in selecting a specific topic and on the writing process. In addition, the candidate will benefit from exchanges with an interdisciplinary team of practitioners at the Institute. The Institute will ensure an adequate remuneration of the candidate commensurate with her/his experience for an expected duration of 3 years. The candidate will be expected to focus on the research for his doctoral thesis during 50 % of his work hours and contribute to the Institute’s practical work in collaboration with various donor organisations during the remaining 50 %. Involvement in project work beyond 50 % is possible depending on demand from partner organisations.

Requirements

  • Graduate degree in law and compliance with the requirements of the Faculty of Law of the University of Basel regarding doctoral studies.
  • Additional graduate or undergraduate degrees in political science, sociology or economics would be an advantage.
  • Work experience (2 to 5 years) in the field of public sector governance.
  • Substantial work experience in low and middle-income countries.
  • Strong interpersonal competence and ability to work in different cultural contexts.

Response Line and Court Advocate Advocate

Program description:
SAFE created the On-Call Advocacy Program (OCAP) to provide on-call staff and volunteer advocates for domestic violence victims who contact the Metropolitan Police Department when DC Superior Court services are unavailable.Response Line Advocates are able to provide services over the phone and coordinate in person meetings.

  • safety planning;
  • legal information;
  • access to Crime Victim’s Compensation applications;
  • emergency shelter;
  • access to the Emergency Temporary Protection Order (ETPO) process; and
  • next-day follow-up from a SAFE Advocate.

OCAP advocates can also assist MPD officers and detectives by answering questions about victim resources, protection orders, and other legal options for domestic violence victims. OCAP advocates collaborate closely with police officers and the community to build
awareness about OCAP services, and about domestic violence as a public safety issue.

Requirements: B.A. or the equivalent, OR 1-2 years of experience with crisis intervention work.

-Maintain detailed records regarding calls for service through the Response Line.

-Work with other DV agencies to provide comprehensive services to victims.

-Provide crisis intervention, safety planning and resources to victims of domestic violence.

-Participate in trainings to enhance knowledge of domestic violence.

Financial Management specialist and Technical Advisor for family and Criminal Justice

The Justice Law and Order Sector (JLOS) is a sector wide approach adopted by Government of Uganda in 1999 to improve the administration of justice, maintenance of law and order and strengthen the rule of law in Uganda.

JLOS thus brings together all institutions charged with the administration of justice, maintenance of law and order and human rights.

JLOS programmes are supported through the sector wide approach to planning, budgeting, programme implementation, monitoring and evaluation with a shift of focus from institutional interests to sector wide strategic interests through a rationalized application of resources from the Government of Uganda and Development Partners.

JLOS is a reform programme run under a common investment plan, whose short term strategic objectives include adherence to the rule of law, fostering a culture of human rights, access to justice, reducing the incidence of crime and contributing to economic development.

In the long term, JLOS strategic objectives will be narrowed to three strategic objectives of strengthening policy and regulatory frameworks, access to justice and fostering a human rights culture and accountability to bring them in line with the National Development Plan.

JLOS is overseen by the Leadership Committee, Steering Committee and Technical Committee with a secretariat made of different advisors who support the four thematic areas of criminal, land, commercial and family justice.

JLOS therefore, wishes to recruit two advisors (consultants) to wit the Technical Advisor for Family and Criminal Justice and Financial Management Specialist on the terms indicated below:

1 TECHNICAL ADVISOR- FAMILY AND
CRIMINAL JUSTICE
Description of the Services

The Technical Advisor, Criminal and Family Justice will provide technical leadership and guidance necessary for successful implementation of the Criminal and Family Reform Programme as follows:

1. Develop researched strategies for effective implementation of the Criminal and Family Reform Programme.
2. Coordinate the development of action plans and budgets for the Criminal and Family Reform Sub- Programmes.
3. Provide technical advice for the implementation of Criminal and Family Reform Sub-Programmes.
4. Contribute to the development of the monitoring and evaluation system particularly for the Criminal and Family Reform Programmes.
5. Monitor and evaluate the implementation of the Criminal and Family Reform Programmes.
6. Prepare quarterly, semi-annual and annual monitoring and evaluation reports on Criminal and Family Reform Programmes.
7. Identify and forward constraints to achievement of the Criminal and Family Reforms to the relevant Committees and Working Groups for redress.
8. Prepare analysed and comprehensive progress reports on Criminal and Family Justice Programmes within the overall reform program for the Semi annual and Annual reviews.
9. To provide secretarial services to the Criminal and Family Justice Working Group and other sector meetings.
10. Perform any other duty that may be assigned from time to time.

Qualifications
The successful candidate should have:
A master’s degree in law from a recognized university.
A thorough understanding of contemporary legal and justice reforms in developing countries such as Uganda.
A thorough understanding of family and criminal justice issues.
At least five years’ experience in programme implementation, legal or access to justice reforms.
Experience working with Donor agencies.
Excellent knowledge of the public sector and
sector-wide approaches to reform.
Understanding of the public sector planning in Uganda

2 FINANCIAL MANAGEMENT SPECIALIST
Description of the Services:

1. The role of the Financial Management Specialist
(FMS) will be to:
i) Coordinate and control activities in the financial management strategy, bearing in mind existing initiatives e.g. the Integrated Financial Management systems of Ministry of Finance, Planning & Economic Development;
ii) Schedule implementation in an orderly, logical and timely fashion;
iii) Submit periodic reports to the Technical and Steering committee, providing status and highlighting problem areas of the implementation;
iv) Prepare terms of reference for the out-sourced work;
v) Drive issues to resolution;
vi) Ensure successful implementation of the financial management strategy.

Key Responsibilities:
2. Key responsibilities of the FMS include:
i) In the short term – oversee the implementation of key procedures to strengthen accountability measures, particularly in regard to non-tax revenue and use of imprest;

ii) Development of training and incentives programme based on needs identified in financial management to enhance capacity and enable retention of skilled staff into the sector;

iii) Develop systems for budget planning process and facilitate preparation of and develop the annual Budget Framework Paper working closely with the sector budget working group, with particular regard to fiscal policy analysis and linkages to the sector objectives, inputs, output and outcomes;

iv) Develop mechanisms for monitoring and tracking utilization of sectoral funds;

v) Analyze and submit financial reports on sectoral programmes including analysis of budgets and budgetary trends for the sector and advice on the overall financial aspects of the sector;

vi) In the long term, provide strategic guidance and oversee implementation of the broad sector financial management strategy, on an annual basis.

vii) Prepare sectoral budget framework paper and other financial report as demanded by Government of Uganda and Development Partners.

Qualifications and Experience:
The qualified candidate should have the following qualifications:
A Financial Management qualification and membership of CPA, ACCA, CIMA, or equivalent.
A Masters in Accounting and Finance will be added advantage.

Must possess proven experience of Project Planning & Management Skills in Public Sector or with an International Organisation for a period of not less that 5 years

Good interpersonal skills, excellent communication (written and spoken) and presentation skills.

A high level of self-motivation, flexibility and ability to work under very tight deadlines.

Human Rights & Justice Specialist

The United Nations Charter affirms the centrality of human rights for the achievement of peace, security, and human development. This was reaffirmed in the Millennium Declaration, when Member States resolved to strengthen national capacity to conform with international human rights principles, treaties and standards, as well as in the Secretary-General’s report: In Larger Freedom. At the Beijing Conference, women’s rights were recognized as human rights. The UN General Assembly continues in its support to progress in the application of the Convention on the Elimination of Discrimination Against Women (CEDAW) and, in a hallmark decision, Morocco has very recently acted to remove all reservations it had placed upon ratification with regards to some of its provisions. The UN General Assembly also adopted the Convention on the Rights of Persons with Disabilities in December 2006. It has received system-wide support from the UN agencies which committed to promote, protect and ensure the full and equal enjoyment of all human rights and fundamental freedoms by all persons with disabilities and to promote respect for their inherent dignity.

At the regional level, the Arab States have made important strides towards the promotion and protection of human rights. The Arab Human Development Report series, 2000-2004, championed by the Regional Bureau for Arab States (RBAS), concluded that Arab countries “need to embark on rebuilding their societies on the basis of: full respect of human rights and freedoms as the cornerstone of good governance, leading to human development and the complete empowerment of Arab women, taking advantage of all opportunities to build their capabilities and to enable them to exercise those capabilities to the full”

Through the application of a Human Rights-based Approach to Development Programming (HRBA) and gender mainstreaming RBAS continues to support its country offices in addressing issues of systematic discrimination, social exclusion and inequality among different segments of societies, including gender-based discrimination and discrimination against persons with disabilities..

RBAS is now seeking to identify a Human Rights Specialist to help further the human rights-based approach to development in support of its country offices.
The post will be anchored in the Governance Practice within the RBAS Regional Support Centre in Cairo, but will work closely with, and inform all other practices and cross-practices.


Duties and Responsibilities

Under the general supervision of the Deputy Regional Director, Regional Support Center, Cairo, the direct supervision of the Governance Practice Leader at the Centre, and in consultation with the Country Operations Division at RBAS HQ, the Human Rights Specialist will perform the following functions:

  • Provide policy, technical advisory support and training in the areas of human rights, including gender equality and access to justice;
  • Provide technical support and capacity development to national human rights institutions and other stakeholders in the countries of the region, in consultation with the relevant COs, to advance the ratification and implementation (including both de jure and de facto compliance) of international human rights treaties, norms and standards and to advance access to justice;
  • Provide technical support and capacity development (including in the area of legislative drafting) for legislative compliance with international human rights treaties, in particular to advance CEDAW legislative compliance and the application to national law of the Convention on the Rights of Persons with Disabilities and its Optional Protocol, which came into force in May 2008.
  • Develop rosters of: human rights, gender and legislative drafting specialists with specific expertise on human rights and gender equality issues in the Arab States region
  • Design, prepare and deliver HRBA training, including of gender specificities, for a range of stakeholders. Support the capacity development of UNDP Country Office staff on human rights, HRBA, gender equality and creating a Society for All.
  • Promote the application of HRBA in development programming, across all Practices/Focus Areas of the Strategic Plan. Raise awareness about and promote the engagement of national stakeholders, including civil society organizations, with international human rights mechanisms;
  • Support resource mobilization, partnership building and knowledge sharing, including contributing lessons learned from the region which can inform global knowledge management practice;
  • Contribute to gender, disability and human rights programming in the UNDP Office and among the UN system at country and regional levels and promote access to justice programing
  • Support international/regional NGOs and CSOs dealing with gender, and human rights issues, including in the areas of economic, social and cultural rights and access to justice
  • Support the Governance Unit in preparing responses to queries from within and from outside of the UN system, the preparation of documentation and organization of meetings and workshops on the subject
  • Monitor and document financial delivery in the area of gender and human rights and access to justice and prepare inputs for the annual report, planning and budgeting, including the regional allocation from the UNDP Global Human Rights Strengthening Programme and Access to Justice program.
  • Collect, research and analyze information on human rights, access to justice and gender issues and identify matters for follow-up and possible action
  • Participate fully in knowledge management networks. Maintain regular contact with human rights advisers/specialists, access to justice and gender advisors and relevant programme personnel, including the UNDP Global Human Rights Strengthening Programme (GHRSP) and the access to justice management teams

Competencies

  • Comprehensive knowledge of, and exposure to, a range of human rights issues;

  • A combination of relevant academic qualifications and work experience can be accepted in lieu of the advanced degree.
  • A minimum of five years of progressively responsible experience in human rights, including gender rights, at international level.
  • Significant experience as trainer and educator on human rights/gender rights
  • Significant experience of UN/UNDP gender and Human Rights policies;
  • Work experience on gender, disability and human rights in the Arab region is a strong asset

Human Rights & Justice Specialist

International Legal Consultant on Access to Justice Survey in Lao PDR

Until 2009 no systematic and comprehensive study had been undertaken on the people’s understanding or perception of their access to justice (including an assessment of access to justice for the poor, vulnerable and disadvantaged people in remote areas including ethnic groups, women and children). In order to redress this, the LBA started to implement a “People’s Perceptions on Access to Justice”. The field study took place in January and February 2010 and gathered information in 4 provinces of Laos. A first draft of the final report synthesizing the data collected and presenting the findings was submitted to UNDP.

Duties and Responsibilities

The consultant will produce the final analysis and inputs to the A2J report with a legal and institutional perspective, and will provide sound advice and recommendations aiming at assisting the Lao government and development partners in the definition of the best strategies and actions to be implemented in the future in order to improve people’s access to justice throughout the country.

  • The revised draft report to be presented at the final stakeholders’ workshop will be submitted no later than on the 20th of April.
  • The final report will be presented within a period of 1 week following the final stakeholders’ workshop and in any case no later than the 30th of June.

The consultant will work remotely except for the sake of his participation in the final stakeholders’ workshop. He/she will then have to travel to Vientiane where travel cost will be covered by UNDP.

Competencies

  • Previous involvement in surveys or formulation missions on access to justice, judicial or legal related work, including relevant experience in the region is essential.
  • Experience in working with governments, institutions and international organizations.
  • Understanding of development issues in Lao PDR including legal, cultural and socio-economic environment is an asset

  • Master degree in Development, Law, Legal Pluralism or other relevant fields of study with strong background in legal research.

Supreme Court Judge

Background

In 2006, the Constitution of the Republic of Vanuatu was amended to increase the number of judges of the Supreme Court from three to twelve. Currently there are five judges of the Supreme Court including the Chief Justice. One Judge is located on the island of Espirito Santo where a branch of the Supreme Court is situated.

Vanuatu's legal system is a combination of the common law and civil system. However, in practice the common law predominates but there the possibility exists for a legal action to be founded on the French civil code in existence prior to independence.

The national languages of Vanuatu are Bislama, English and French. Despite the great difficulty in unifying laws based on the very different English and French traditions, Vanuatu has sought to establish a single system based on British criminal procedure and the French penal code. The constitution establishes a Supreme Court, with a Chief Justice and three other judges, as well as an Appeals court. Village and island courts have jurisdiction over customary and other matters.

Purpose of the project

To enhance the institutional capacity of the Supreme Court to effectively deal with delays and backlog of cases.

Duties and Responsibilities

The project will provide a Supreme Court judge for a period of two years. The appointed judge will be based at the Supreme Court in Port Vila and will work closely with the Chief Justice and two locally appointed Supreme Court judges.

During the implementation period it is expected that the appointee will undertake the following activities, inter alia-

  • preside over all cases as assigned;
  • assist the Chief Justice on developments with regards to commercial law;
  • assist the Chief Justice on developments of case management processes, systems and rules with regards to commercial cases;
  • provide mentoring to the locally appointed judges with regard to judgments in commercial cases;
  • assist the Chief Justice with any national judicial training programs; and
  • Assist with any other request made by the Chief Justice.

Outputs (Deliverables)

  • Increased rate of disposition of cases in the Supreme Court;
  • Trained locally appointed judges in commercial cases;
  • Working case management processes and rules for commercial cases; and
  • Timely disposition of cases in the Supreme Court.

Implementation Arrangements

The Expert will work closely with Commonwealth Secretariat Advisers in delivering this technical assistance. The Expert will be based in the Supreme Court in Port Vila for a period of two years and will report to the Chief Justice of the Republic of Vanuatu or nominee.

Senior Legislative Drafter, Office of the Parliamentary Counsel

Background

The Office of the Parliamentary Counsel (OPC) is the Law Office of the Government of Jamaica, charged with the responsibility for legislative drafting. It consists of a cadre of attorneys-at-law headed by the Chief Parliamentary Counsel (CPC) and supported by administrative and secretariat staff. Its mission is to facilitate the Government’s request for the preparation of draft legislation in fulfilment of its legislative programme. In pursuance of policy decisions at the Ministry level, the OPC gives counsel to Parliament in the exercise of its law-making powers by providing advice on the draft bills it seeks to enact. In carrying out these functions, the OPC drafts Bills and subsidiary legislation on instructions from client Ministries, advises Ministries on points of law relevant to proposed legislation, and examines and comments on all draft Cabinet submissions related to legislation.

The Government of Jamaica has articulated various legislative measures to address the growing crime rate, tackle corruption, introduce constitutional changes, address gaps in social protection, as well as those required by international conventions to which Jamaica is a signatory. The Government’s National Security Policy has recorded the need for legislation to be continuously reviewed and revised as offenders use new methodologies, technology and other creative ways to avoid prosecution. There is therefore a significant and growing demand for new and revised legislation to treat with the above issues.

There currently exists a capacity challenge within the OPC relating to the numbers of experienced drafters available to draft urgent laws specifically relating to anti-corruption and crime. The OPC is currently below its complement of drafting staff, this fact as well as the volume of annual legislative drafting requirements are adversely affecting the pace at which Bills are tabled in Parliament.

Purpose of the Project

The purpose of the project is to strengthen the Government of Jamaica’s ability to respond to the increasing demands for timely and effective legislation.

The goal is to enhance the capacity of the Government of Jamaica to develop effective legislation in a timely manner. The primary focus will be on supplementing the legislative drafting capacity of the Ministry of Justice, Jamaica and in particular the OPC, in the effective and efficient preparation of legislation, notably, criminal and anti-corruption legislation.

Scope of Work

The Expert will be based at the office of OPC, Ministry of Justice, Kingston, Jamaica and will work closely with the counterparts in the drafting team.

During the assignment the expert will be expected to undertake a number of activities, including:

  • Assessing current legislation in progress and matters outstanding on the legislation programme;
  • Drafting of specialised legislation notably, criminal and anti-corruption;
  • Undertaking training needs assessment of legal personnel within the OPC, and implementing a training and mentoring framework to bridge any knowledge or skills gap;
  • Training of identified personnel within line ministries in the processes involved in the development of legislation and in particular the formulation and submission of drafting instructions;
  • Providing advice to government departments on legal and legislative issues arising in relation to proposed legislation;
  • Attending and contributing at Legislation Committee Meetings and other relevant fora;
  • Developing a legislative drafting handbook for use by line ministry officials and a legislative drafting manual for drafters within the OPC.

Outputs/Deliverables

  • Specialised legislation, including criminal and anti-corruption laws drafted.
  • Ministers and other Government Departments advised on legal and legislative issues arising in relations to proposed legislation.
  • Office of the Parliamentary Counsel legislative staff trained and mentored in drafting anti-corruption and criminal legislation.
  • Legal personnel in line ministries, trained in the processes involved in the development of legislation and in particular the preparation of clearly articulated drafting instructions.
  • Functional guidelines developed for use by line ministry officials and a legislative drafting manual for drafters within the OPC.

Transfer of Expertise

The Commonwealth Secretariat attaches particular importance to the transfer of expertise and knowledge to counterparts. Experts appointed will be expected to share their skills and experience with staff of the Office of the Parliamentary Counsel. A comprehensive training and mentoring programme will be implemented in this regard which will aim to ensure that staff trained will have the necessary skills to fulfil drafting requirements with more confidence and less close supervision upon project completion.

Implementation Arrangements

The expert will work closely with Commonwealth Secretariat Advisers in delivering this technical assistance. The expert will be based at the Office of the Parliamentary Counsel for a period of two years reporting directly to the Chief Parliamentary Counsel.

Person Specification

The successful candidate should have:

  • A Bachelors Degree in law and or post-graduate qualifications in criminal and anti-corruption legislation;
  • At least 15 years experience in legislative drafting, acquired within Commonwealth jurisdictions, particular experience in drafting legislation relating to criminal and anti-corruption matters is highly desirable;
  • Experience in providing professional advice concerning legislation on crime and anti-corruption at a senior level;
  • Demonstrated expertise in legal analysis and drafting in the specialised areas of anti-corruption and crime;
  • Strong communication, writing and IT skills;
  • Ability to establish priorities and to plan, coordinate and monitor own work;
  • Excellent interpersonal skills, ability to work in a consultative and collaborative manner;
  • Ability to establish and maintain effective partnerships and working relationships in a political environment;

Prosecutor, Criminal Division, Attorney-General’s Chambers

Background

Over the past ten years, the Commonwealth Fund for Technical Cooperation (CFTC) has provided intensive capacity building assistance to support and strengthen the judicial processes in The Gambia. Accordingly, several judges and prosecutors have been made available by the fund in the past, with a view to reducing case backlogs and improving structural efficiency and effectiveness within the courts of The Gambia. In the more recent past, the Commonwealth Secretariat has collaborated with the UK Government’s Department for International Development (DFID) to further the aims of this project. Notwithstanding the significant reduction in the backlog of cases to date, considerable constraints still exist in relation to the number of judges and prosecutors effectively placed to manage and adjudicate outstanding cases.

In addition to the placement of two Prosecutors within the department of prosecution, an institutional capacity assessment is proposed to look specifically at its institutional capacity. This will help to ensure the sustainability of our intervention in the longer term. It is the expectation that the appointed prosecutors will implement the recommendations of the report through mentoring, guidance and institutional links created during the assessment.

Purpose of Project

The project aims to build on the CFTC previous and ongoing interventions to The Gambia Government, through the provision of support to the Judiciary. The primary goal of the project is to facilitate stronger and more responsive judicial processes in The Gambia.

Scope of Work

The expert will be based at the Attorney General’s Chambers in The Gambia for a period of two years and will closely work with the Director of Public Prosecution, Solicitor General and Legal Secretary and, other prosecutors. During this period the expert will undertake the following activities.

  • Criminal prosecutions on behalf of the State;
  • Advising government ministries, including the Director of Public Prosecution, Solicitor General and legal secretary, parastatals and public enterprises on criminal matters;
  • Building capacity aimed at improving the skills and knowledge of staff within the public prosecution department;
  • Improving the operational effectiveness of the department of public prosecution.

Project Outputs

  • Criminal prosecutions are conducted in a timely and efficient manner;
  • Timely, relevant and honest professional advice provided to government and stakeholders;
  • Strengthened capacity of the prosecutors in the Attorney General’s chambers;
  • Improved operational effectiveness of the public prosecution office – incorporating approved recommendations of the institutional assessment.

Transfer of Expertise

The Commonwealth Secretariat attaches particular importance to the transfer of expertise and knowledge to counterparts. It is the expectation that the expert will assume more of a mentorship and advisory role during the final year in post, when a national is expected to take up the substantive position. The assigned expert will work closely with the Director of Public Prosecution, Solicitor General and Prosecutors by providing professional support to the prosecution team and in particular to mentor the junior and less experienced prosecutors.

Implementation Arrangements

The expert will work closely with the commonwealth Secretariat Advisers in delivering this technical assistance.

Required Experience and Qualification

Essential:

  • The candidate should be qualified to practice as a barrister in a Commonwealth country, with a minimum of ten (10) years post call experience as a prosecutor.
  • Familiarity and considerable practical experience (a minimum of ten years post qualification experience) in criminal advocacy and litigation, and the practice of emerging transnational crimes,
  • Proven ability to construe and apply statues,
  • Experience in providing professional training and development.

Preferable:

  • A Masters degree in Law from a recognised institution with previous experience in providing technical assistance relating to prosecutions in developing/or transitional countries;
  • Thorough background in research, legal analysis and the provision of legal advice in complex matters;
  • Experience in case management systems;
  • Ability to write informed and concise reports;
  • Excellent communication skills;
  • Excellent command of the English language, both oral and written;

Chief of Party – Legislative/Parliamentary Strengthening, USAID/Haiti

DAI, a global consulting firm headquartered in Washington, DC, USA seeks to fill an anticipated Chief of Party position for a U.S. Agency for International Development (USAID)-funded project in Haiti, related to legislative and parliamentary strengthening. Core requirements include: experience with donor-funded legislative strengthening programs; international development experience, especially in francophone countries; and fluency in French and English. This is a long-term position.

Responsibilities:

The Chief of Party will be responsible for leading project's technical direction and providing management oversight for project activities. He/she shall act as the primary point of contact with donor agencies with regard to day-to-day implementation and management matters relating to the contract. He/she will be responsible for the technical leadership and management of all the technical activities of the project. He/she will oversee a long-term expatriate and local team and short-term experts in achieving project results. He/she will be responsible for evaluating and documenting progress (activity monitoring reports), managing design and evaluation teams, evaluating sub-contractors’ and grantees’ activities through consultative meetings and site visits, working out solutions to keep the activity on track and providing overall guidance and direction focusing the activity team on achieving agreed targets and long-term strategic objectives. The COP will have overall responsibility for assuring that all assistance provided under the contract is technically sound and appropriate for the needs to be addressed. The COP shall have overall responsibility for ensuring quality control, the appropriateness and overall responsiveness of all assistance provided under the contract. He/she shall be able to provide guidance and direction as to team building and participatory management.

Required Qualifications:

  • At least five years experience with national legislative institutions as an elected representative or staff member, or in a position of direct engagement with the legislature;
  • Technical knowledge in one or more of the following areas:
    • Administration and management of legislative institutions, staff and budgets;
    • Knowledge of parliamentary procedure and legislative drafting;
    • Public policy development and advocacy;
    • Development, passage, monitoring and auditing of public budgets;
    • Training and orientation for new Members and staff;

Legal Drafters Training Coordinator

TERMS OF REFERENCE

I. Profile of the Post

II. Organizational Context

Timor-Leste became independent in 2002. A democratic semi-presidential governance system based upon separation of powers and mutual cooperation of the institutions of state was developed.
The National Parliament is the cornerstone of the democratic system and good governance. It is currently comprised of 65 members. It is headed by the President of the National Parliament. Nine political parties have constituted in their benches. Detailed parliamentary scrutiny of legislation and government actions is delegated to 9 standing committees of multi-party composition. The parliamentarians are supported in their work by a Secretariat of approximately 81 staffs which is headed by a Secretary General with a category of 66 permanent staffs and 15 temporary staffs. The Secretariat is divided into three directorates and 12 divisions of which assume responsibility for work in the general areas of Finance and Administration, Plenary support, Committee support, and library and documentation functions, communications and public relations, and Information, communications and technology. This organizational structure is under establishment and functioning following the new 2008 Administrative and Service Law of the Parliament (LOFAP).

The National Parliament was established from scratch in a setting of largely inexperienced parliamentarians; an acute shortage of skilled personnel and significant language barriers. Systems and processes are in the early stages in some cases and non-existent in others. Achievements are not yet consolidated and many challenges can only be overcome with long-term assistance. UNDP has supported the growth of the legislature since 2003. The Parliament Project 2010-2013 is a revision of the previous project of 2006-08 extended to 2009, and comprises comprehensive capacity-development interventions in five strategic areas: oversight capacity; legislative support; democratic representation, transparency and accessibility; strengthening parliamentary administration and secretariat functions, and gender mainstreaming. The overall objective of the project is to develop the institutional capacities that allow the parliament to fully and effectively perform its constitutional mandate and to lay down exit strategies for nationals to take over internationals role in the near future.

Under the framework of the UNDP National Parliament Project 2006-2009 and continued to Parliament Project 2010-2013 an additional Letter of Agreement between UNDP Timor-Leste and the National Parliament of Timor-Leste signed to put in practice the Parliament is pursuing the objectives of improving its institutional and human resources capacity with the objective of strengthening its efficiency, independence and effectiveness. The Letter of Agreement provides for capacity building of Timorese with different areas of expertise relevant to the work of the Parliament to be trained by the project and further absorbed into the structure of the Parliament.

Legislative Support is a core component of the UNDP Parliament Project. The establishment of a research services, inclusive of capacity building/training of National Legal Drafters/Analysts within the National Parliament was envisaged in the recommendations of the project mid-term evaluation mission conducted in January 2008. The Parliament has recently created the Directorate of Research and Technical Information, through the newly approved Parliamentary Administration Law (December 2008). A legal training programme for National Legal Drafters/Analysts has been agreed upon between the UNDP National Parliament Project and the National Parliament of Timor-Leste, including the recruitment of international trainers for the accomplishment of the task.

The Legal Drafters training programme has already been developed and submitted to the Pedagogic Board of the Legal Training Centre for formal approval. In the meantime, classes have already started in January for 10 legal drafters. The coordinator will perform primary responsibilities of the implementation of the programme. The coordinator will also perform direct supervision to the training staff, both the Assistant Trainers and the Trainees and provide update to the National Parliament and UNDP.

III. Functions/Key Results Expected
The National Parliament has delegated direct supervision of the Legal Drafting Training Coordinator to the Project Manager of UNDP Parliament Project with indirect supervision by the Secretary General of the National Parliament of Timor-Leste. The Legal Drafters Training Coordinator will perform the following functions:

Summary of Key Functions:

1. Implementation of the training programme for the Legal Drafters of the National Parliament;
2. Conduct examinations and evaluations of the trainees of Legal Drafting Training Programme;
3. Coordinate with the Legal Training Centre of Ministry of Justice on the implementation of all training programmes of the Legal Drafting Training Programme of the National Parliament;
4. Effectively manage the legal Drafting Training Programme of the National Parliament;
5. Develop and implement a strategy for the Nationalization of Legal Advisers in the National Parliament

1. Ensures the design, development and implementation of curricula and summaries, focusing on achievement of the following results:
- Design, develop, and consolidate curricula and summaries for the training programme with the Legal Training Centre and according to the Parliament Project Document and policies set by Project Steering Committee of the UNDP Parliament Project
- Implement comprehensive training programmes, design materials and lesson plans.
- Adapt training curricula according to the policies set by the Project Steering Committee of the Parliament Project.
- Transfer skills and theoretical knowledge to students.
- Apply global best practices in the implementation of the training;
- Perform teaching functions and guidance to the trainees in practicing legal research skills during the training programme, including editing of the works of the students;
- Supervise the trainees’ work, review their performance, and evaluate their achievements.

2. Ensures examinations and evaluations of students are conducted focusing on achievement of the following results:
- Prepare, organize and conduct regular examinations, evaluations and other activities related to the training as required.
- Ensure that graduated students have the required level of competency to assume Legal Drafting/Analyst functions, according to the Rules of Procedures of the National Parliament RDTL and in compliance with the Law in the country.


3. Ensures the coordination of all courses of the Legal Drafting Training Programme, focusing on achievement of the following results:
- Coordinate all envisaged courses, including management of lecturers and resources
- Ensure access of the legal drafters of the National Parliament to resources and facilities of the Legal Training Centre.
- Share with UNDP and Parliament document lessons learned and use input for continual improvement and development of courses.
- Coordinate with the UNDP Parliament Project Advisers to develop a mentoring strategy for legal Drafters
.
4. Ensures effective programme management focusing on achievement of the following results:
- Ensure strategic management of the Legal Drafting Training Programme for legal drafters of the Parliament;
- Supervise, provide leadership and strategic guidance to the trainees and evaluate their performance in jointly with the LTC team.
- Establish guidelines and reporting standards for monitoring and evaluation of activities, in agreement with Programme Management.
- Prepare and submit regular activity progress reports to the Project Manager of UNDP Parliament Project;
- Participate in the regular UNDP Parliament Project Staff meetings;
- To provide regular updates on the progress of the training programme to the Secretary General of the National Parliament, the Mesa, and the Project Manager of UNDP Parliament Project;

5. Ensures strategy is developed and implemented for the Nationalization, focusing on achievement of the following results:
- To assess impact of the first year legal drafters training programme and design a new three years strategy for further Legal Drafting Training Programme;
- Ensure that Legal Drafters abide by the National Parliament and code of ethics;
- Advise on the development of a strategy aiming at the nationalization of the Legal Drafters Team of the National Parliament, which involves scaling down the number of international advisors after 2013.
- Establish synergies and partnerships with national legal institutions and with the Timor-Leste Faculty of Law and international institutions mainly of CPLP members for the development and implementation of trainings and seminars.

IV. Expected Results:

- Strategy Paper for the 2011 to 2012 Legal Drafting Training Programme;
- Curriculum for the 2011 to 2012 Legal Drafting Training Programme
- Definitive Weekly and Monthly Schedule of the Legal Drafters training programme;
- Regular training progress reports (Weekly Log, Quarterly Reports, and annual reports of the Legal Drafters training implementation);
- Teaching-Learning Materials of the Legal Drafters training programme;
- Reports of Evaluation of the Legal Drafting.

• Experience in coordinating, designing and implementing training programmes for Legal Drafters/Analyst for government/Parliament;
• Teaching Experience in Law at University;
• Experience in providing advisory services and mentoring;
• Experience in post-conflict situations/developing countries;
• Knowledge of international human rights standards and instruments.

Language Requirements:
Fluency in Portuguese. Good command of English, knowledge of Tetum or/and Bahasa Indonesia will be an asset;
